FDA Report Encourage Retailers to Stop Selling Illegal Vapes

According to the official website of the US Food and Drug Administration (FDA), in order to strengthen the crackdown on illegal vape products and protect the health of young people, FDA Commissioner Marty Makary issued a statement on September 30, officially launching a new initiative for retailers, calling on retail channels including vape stores, convenience stores, and gas stations to actively stop selling illegal vape products.

According to FDA estimates, approximately 54% of vape products sold in the United States are illegal.
These illegal products often contain harmful substances such as formaldehyde, lead, and acrolein, which are commonly used in industrial textiles or insecticides. Long term use may cause serious harm to the human body.

This initiative aims to enhance retailers’ awareness of the scope of legal product sales. The FDA stated that many community retailers are still selling illegal vapes specifically targeting teenagers, with fruit or candy flavors, and even products with built-in video games or Bluetooth speakers. Most of these products are not authorized by the FDA and are mainly illegally imported from China.
To help retailers clarify the boundary between legal and illegal products, the FDA will send guidance materials to over 300000 retail outlets across the United States, including:

A list of 39 vapes and 20 nicotine bag products currently approved for sale in the US market, with QR code links to the FDA official website for real-time updates;
The FDA’s newly launched “Tobacco Product Searchable Database” covers over 17000 legally marketed tobacco products, including cigarettes, cigars, hookahs, and vapes;
The latest retailer education materials, such as calendar style reminder materials for posting, remind sellers that they can only sell tobacco products to customers aged 21 and above, and that customers under 30 must verify their photo identification.

Commissioner Makari emphasized:
We know that most businesses have the willingness to comply with the law. The goal of this new measure is to clear information blind spots and allow retailers to sell illegal products without excuses
He expressed his special hope to curb the circulation and sales of illegal vape products through this action, which are currently widely used among the youth population.
