Italian Man Injured In Vape Explosion Lawyer Files Lawsuit

All this resulted in a complaint addressed to the Rimini Public Prosecutor’s Office to which the young man asked to intervene to ascertain the causes that may have led to the alleged explosion and the compliance of the device he purchased in a store specializing in the sale of smoking products.

It all happened around 7.30 on Thursday, while the young man from Misano was getting ready to go to work. Like every day, he had just left the house, wearing the pants in which he kept, in his left pocket, his 80W vaping device. Suddenly, according to the 25-year-old in his complaint, the device would have generated a flame that enveloped the boy’s left thigh, completely burning his pants and causing second-degree burns.

In panic and in an instinctive attempt to get rid of the burning object, the young man also burned his right hand. The pain and fright made him stagger, until he fell ruinously to the ground, hitting his head against a nearby concrete planter. The impact with the ground caused a deep wound on the head, with blood loss.

The boy was urgently transported to the emergency room of the Ceccarini hospital in Riccione, where doctors performed a suture with 50 stitches to the head. The burns to the thigh and hand have been treated and the prognosis is ten days. The electronic device, according to what was reported in the complaint-lawsuit filed through the lawyer Stefano Caroli of the Rimini bar, had been purchased regularly in a shop in the area and despite being produced in China it was equipped with the CE mark, guaranteeing compliance with European safety standards.

In the complaint, the lawyer asks the authorities to ascertain the actual compliance of the device with the regulations in force on safety and protection of public health.

The complaint hypothesizes the crimes of culpable injury and, depending on the results of the investigation, also possible violations in the field of counterfeiting and product safety. Not only that: the complaint – addressed to the Chinese vape manufacturer and the Italian distributor of the vape brand – also includes the request for preventive seizure of similar devices. In the meantime, the young man from Misano is recovering from his injuries and has announced, through his lawyer, his intention to become a civil party in the event that the matter were to land in court.
