The United States International Trade Commission (USITC) has officially launched an investigation into a Section 337 case involving vape devices. The investigation stems from complaints submitted by JUUL Labs and its affiliated companies, alleging that Glas vape devices, pods, and their components infringe upon their US patent rights. JUUL requests the committee to issue a limited exclusion order and a cease and desist order after the investigation is concluded.

4. The products involved in the case include vape devices, pods, and related components;

This investigation originated from a complaint submitted by JUUL Labs, Inc. and VMR Products LLC on September 30, 2025.
According to Article 337 of the 1930 Customs Law. The investigation will be officially launched on December 16, 2025, involving some vape devices, pods, and their components.
Subsequently, the complainant submitted supplementary materials on November 18th, November 25th, and December 1st and 2nd, respectively. The complaint alleges that the vape products in question violated some of the claims of US Patent No. 11134722 and No. 11606981 during importation into the United States, sale for importation, and sale within the United States after importation.
According to the investigation scope, the products involved include vape devices (ENDS devices), their accompanying cartridges (also known as “pods”), and related components such as pod casings, atomizers, atomizer sub components, and device sub components.
USITC stated in the notice that JUUL Labs, Inc. and VMR Products LLC are the complainants in this case; The complained parties include Glas, Inc. and Glas, LLC located in California, USA.
