Juul Labs sues NJOY and Altria Group again, accusing their e-cigarette products of patent infringement

According to the official website of Juul Labs on August 8th, Juul Labs has filed a lawsuit against NJOY Corporation and Altria Group with the United States International Trade Commission (ITC) and the United States District Court for the District of Arizona. The lawsuit accuses NJOY DAILY vape products of infringing on a patent of Juul Labs.
This lawsuit is the latest development in a series of disputes between the two companies since 2023. In 2023, Altria Group completely divested its equity in Juul Labs and did not obtain a license to use Juul Labs’ intellectual property. Subsequently, Altria Group acquired NJOY and its products developed in China, which infringed on Juul Labs’ patented technology.
The filing of this new lawsuit stems from Juul Labs’ victory in the International Trade Commission earlier in 2025, when the Commission ruled that the NJOY ACE vape product developed by Altria Group in China infringed four patents claimed by Juul Labs and banned the product from being imported into the United States.
In the same month, the International Trade Commission also terminated another patent infringement lawsuit filed by Altria Group against Juul Labs, as it determined that Altria Group’s claimed patent had not been infringed.
Recently, Altria Group informed Juul Labs that it plans to restart federal court proceedings against Juul Labs based on the same batch of patents that were not supported in the International Trade Commission lawsuit against Juul Labs.
