The Kentucky Department of Public Protection stated that by January 1, 2026, retailers selling tobacco, nicotine, and vape products throughout the state must obtain an annual operating license issued by the Kentucky Alcoholic Beverage Control (ABC). After the new regulations come into effect, state law enforcement agencies will conduct regular and surprise inspections, and impose higher fines for violations.

Starting from January 1, 2026, all businesses selling tobacco, nicotine, and e-cigarette products must hold a state-level license.
The new law requires online application for licenses through the Kentucky Alcoholic Beverage Control (ABC).
Enforcement measures include: irregular compliance checks to prevent sales to minors; Increase fines and criminal penalties for violations; Establish a new consumer complaint investigation team.
The fine will be used to fund a youth vaping prevention project.

Kentucky Department of Public Protection Secretary Ray Perry stated that nicotine and vape products are becoming easily accessible to minors, leading to an increase in the use of vapes among teenagers. This measure will empower the Kentucky team with stronger law enforcement capabilities to protect young people from harmful products.
According to Senate Bill 100 previously signed by Governor Andy Beshear, all tobacco, nicotine, and vape retailers must obtain an annual license through Alcoholic Beverage Control. The bill also strengthens law enforcement and punitive measures, including:
1. Regular and surprise inspections are conducted to ensure that retailers do not sell products to minors or illegally;
2. Impose higher fines for violations, and revoke licenses or pursue criminal responsibility;
3. Establish a new enforcement team to investigate consumer complaints.

The state government stated that some of the fines will be used to fund public health programs aimed at preventing teenagers from vaping.
The Alcoholic Beverage Administration reminds businesses planning to continue selling related products after January 1, 2026, to submit their applications through the Alcoholic Beverage Control Online Licensing Portal as soon as possible to ensure sufficient processing time. The system was officially launched last week.
