UK Plans To Legislate For Vape Retail Licensing System

According to Daily Mirror and Nottingham Post on October 8th, the UK government is drafting a retail licensing system to make the sale of vapes and cigarettes without a license illegal; At the same time, seek expert opinions on the taste, nicotine content/formula, packaging, and appearance design of vapes to curb their use by minors and crack down on non compliant retail.

Key information:
1. Licensing system: Only retailers holding valid licenses are allowed to sell vapes, cigarettes, and other nicotine products; Selling without a license will be considered illegal.
2. Punishment: Unlicensed sellers may be subject to an unlimited fine or a maximum fine of £ 2500 on the spot.
3. Expert consultation: The government has extensively solicited opinions on the taste, nicotine content/formula, packaging, and appearance of vapes.
4. Regulatory loophole: Under the current framework, “any enterprise” can sell tobacco and vapes, which has been accused of creating a loophole that makes cheap and illegal products more easily accessible to minors.
5. Legislative process: The Tobacco and Vape Bill aims to promote a ‘smoke-free generation’ and discourage minors from developing long-term dependence, and is currently under parliamentary proceedings.

The government stated that the proposed plan aims to fill the legal gap, clarify compliant retail channels through a licensing mechanism, and provide a basis for law enforcement. The above measures aim to better protect minors while helping adults identify compliant stores and legal products.
At present, the government is simultaneously soliciting opinions from experts on taste, nicotine intensity, and product design, and intends to improve and refine the rules accordingly. The penalties and licensing requirements are proposed in the proposal, and the final decision will be based on the parliamentary review results and supporting regulations.
