Vuse Vape Accused Of False Carbon Neutral Face $5 Million Lawsuit

British American Tobacco (BAT) has been accused of false carbon neutrality advertising for its vape brand – Vuse.

1.Consumers have filed a class action lawsuit in the Northern District Court of California
They are demanding $5 million in compensation.
One core of this lawsuit is that Vuse was once promoted as the “world’s first global carbon neutral vape brand“.
But these environmental claims were allegedly made through carbon credits that did not actually improve the environment.

RJ Reynolds is subsidiary of British American Tobacco.

Even after learning of false credit, British American Tobacco continue to promotes Vuse vape products under the guise of carbon neutrality.
More than one-third of the credits used to offset Vuse emissions come from the Guanar é Forest Plantations Project in Uruguay.
The project is a eucalyptus farm in Uruguay, which was rated as zero by an independent rating agency in 2022.
This means that these credit lines were supposed to represent one ton of emissions reduction, but in reality, there has been no change.
The lawsuit claims that this farm and three other forestry projects that were found to have exaggerated their sustainability claims account for the vast majority of the credit lines required for Vuse to be declared carbon neutral.

5.The court held that companies making environmental claims in marketing must diligently prove these claims, and British American Tobacco and its subsidiaries violated these obligations.

6.A spokesperson for British American Tobacco stated in November 2024 that the “carbon neutrality” statement had been independently verified in 2021, and all Vuse promotional information related to carbon neutrality had been terminated by December 2023. A press release from 2021 called Vuse the “world’s first carbon neutral vape,” which is still available on the website of British American Tobacco.
