Texas vape law: banning the sale of vape products from China

The Texas State Legislature has revised SB 2024, significantly strengthening the regulation of vape products.

For prohibiting vape products containing e-liquid produced by China or “hostile countries“.This link is country designated by the US Secretary of Commerce as a foreign hostile force under federal regulations.
Elevate violations to Class A misdemeanors.
The new regulations also expand the regulatory scope to nicotine free products, prohibit the addition of ingredients such as cannabinoids.
And strengthen restrictions on inducing underage marketing.
Additive ban: It is explicitly prohibited to use vapes containing or mixed with substances such as cannabinoids, alcohol, cardamom, kava, psychedelic mushrooms, and tianeptin.
Marketing restrictions for teenagers: continuing to prohibit the use of cartoon packaging, food appearance, celebrity endorsements, and other methods to attract underage vape designs.
The revised bill bears some similarities to the recently passed Electronic Cigarette Catalog Act (SB 763) in Tennessee.
Tennessee’s SB 763 bill will establish a Market Authorization for Electronic Cigarette Products (PMTA) catalog system and impose wholesale taxes on electronic cigarette products for the first time. SB 763 imposes restrictions on the sources of ingredients in electronic cigarettes, requiring manufacturers to declare that the “consumable substances” in atomized products are processed or mixed in FDA registered US factories and cannot come from “hostile countries”.
The revised bill in Texas also means that if the final version is signed by the governor, Texas will allow the sale of Chinese made e-cigarette devices filled with American made e-liquid.
The financial statement from the Texas Legislative Budget Committee indicates that upgrading illegal behavior to an A-level misdemeanor may increase fine revenue, but the specific amount cannot be determined yet. It is expected that this bill will not have a significant impact on the state’s correctional population or resource needs.
